Congress Votes to Extend the Therapy Cap Exceptions Process for Medicare

On February 17, 2012, the House and Senate passed the conference report for H.R. 3630, the Middle Class Tax Relief and Job Creation Act.  H.R. 3630 avoids the approaching  27.4% cut to Medicare Part B reimbursements and extends the therapy caps exceptions process through December 31, 2012.

Congress added additional requirements to the exceptions process, including:

  • The use of an NPI for the physician reviewing the need for therapy;
  • Requirement of the KX modifier on claims above the cap; and
  • Requirement for medical manual review when therapy expenditures hit $3,700 (combined physical therapy/speech-language pathology) for services furnished on or after October 1, 2012.

The bill will temporarily apply the therapy caps and exceptions to hospital outpatient departments for services provided no later than October 1, 2012, and ending December 31, 2012. Previously HOPD were exempt from any cap.  This change will uniformly apply the cap and its extensions to allow for patient access and non-favoritism of one particular provider type over another. Extending the temporary cap to HOPD with exceptions creates a uniform system of utilization control across all outpatient settings and does not restrict access to medically necessary care.

Extending the therapy caps exceptions process offers only short-term relief.  Please visit your national organization website for direction on their PAC directives.   Most have call to action initiatives with a simple click to write letters to your appropriate member of Congress to express your concerns.  The American Speech-Language Hearing Association,   the American Physical Therapy Association and the American Occupational Therapy Association, as well as Congress have been working to development alternatives to the therapy cap the is of mutual benefit to beneficiaries and their healthcare providers.

My ITPA: Top 10 Questions from SLP Practitioners

What do I get from my ITPA membership as an SLP?  

 

 

My ITPA, with its unlimited opportunities  to network, discuss, and help resolve common issues facing SLPs in private practice, within an open forum, is just one reason to join.

Here are “Top 10″  concerns about providing services in a private practice setting which were raised at the recent annual networking dinner in San Antonio:

 

 

 

    1. Lack of coverage for ST services by private insurance plans.
    2. Lack of coverage, or inconsistent coverage, for developmental delays.
    3. Reimbursement rates that are too low to meet actual costs.
    4. Reimbursement rates varying between managed health care organizations.
    5. Excessive, multiple demands for notes and reports in order to get claims paid.
    6. Provider liability for recoupment at any time, and without any protection.

Nice to see so many of you at the Texas Speech Language Hearing Convention

ITPA had phenomenal success recruiting new members at the TSHA state convention in San Antonio this weekend.  Speech Therapists in the state of Texas were hungry for the information and advocacy ITPA has to offer!

Of equal importance, we were able to recruit many new volunteers to assist us in our efforts to garner equal pay for independent therapist and therapy clinics in Texas! Physical, Occupational and Speech Therapists in private practice deserve reimbursements that can sustain business and keep us competitive in our markets.  ITPA’s success in maintaining independents rates in Texas Medicaid was an example of your ITPA dollars at work!  Those who know the system best were able to crunch numbers and make an outstanding case for fair compensation.  We continue to view the reimbursement disparity as a top priority and we were happy to discover so many new voices throughout the state who feel the exact same way!!

It was nice to meet so many of our members face-to-face at the TSHA convention.  We look forward to meeting the rest of you at the Texas OT and PT conventions in the future!

ITPA recieved the following statement from HHSC. No further hearings are expected.

We want to provide you with an update on the proposed changes to Medicaid reimbursement rates for therapy services provided by Comprehensive Outpatient Rehabilitation Facilities/ Outpatient Rehabilitation Facilities (CORFs/ORFs), independent therapists, and home health agencies.

 

Based on feedback received on the proposed rates presented at the November 21, 2011, rate hearing, HHSC further modified the proposed rates and presented them at the January 18, 2012, rate hearing. The further modified proposed rates presented at the January 18, 2012, rate hearing will be implemented effective March 1, 2012.

NEW MEDICAID RATES HAVE BEEN POSTED

ITPA will hold a member meeting January 3 to discuss how we would like to proceed and what our uniform response will be at the Jan 18, 2012 rate hearing.  If you have not yet joined ITPA, please do so now so that your voice can be included in the formal ITPA position.  Only members in good financial standing will be permitted to participate in the meeting and decision making process.

We are encouraged by HHSC’s willingness to exchange information with our board and we anticipate further cooperation.

Rate Reduction Hold is official!

True or FalseHHSC is preparing for another rate hearing which will be held in late January or early February 2012.  HHSC made their rate reduction hold official and it has been posted to TMHP’s website: http://www.tmhp.com/Pages/Medicaid/Medicaid_home.aspx

The reimbursement rate changes for physical, occupational, and speech therapy services that were proposed at the November 21, 2011, rate hearing will not be implemented for dates of service on or after January 1, 2012. Services that are performed by comprehensive outpatient rehabilitation facility (CORF), outpatient rehabilitation facility (ORF), independent practitioner (including a provider of Early Childhood Intervention [ECI] therapy), home health agency, and nursing facility providers are affected.

A future notification will be published when an implementation date has been set for the rate changes to become effective.

Providers should monitor the Texas Health and Human Services Commission (HHSC) website at www.hhsc.state.tx.us/news/meetings.asp for information related to a public rate hearing for these reimbursement rates, which will be held at a future date.

Confirmation needed

It has been reported that Billy Millwee, HHSC Executive Commissioner for HHSC has decided to put the rate reductions on the back burner until after the managed care roll out in March.  This would mean rate reductions wont be addressed until April or May of 2012.  We are working to get this information in writing and officially posted to TMHP as quickly as possible.

While we hope this is true because it buys us time, it is not to be viewed as a victory at this point.  We have much work to do and we continue to need your support, and above all, an increased membership!!  We have been able to accomplish quite a bit in a short amount of time!  Please consider inviting your friendly competitors to join our organization as well.

Rate reductions postponed…possibly….

WOW!  What a long and emotional day we had yesterday.

The rate hearing ran from 1:00pm until they cut off the last speaker at 5:00.  Because the turnout was so overwhelming, it was not possible for all present to have a turn to speak.  Even if you were not able to make a public statement, your written testimony will be reviewed by HHSC.

Thank you SO MUCH to all the ITPA members who were able to attend yesterday’s hearing.  Even if time ran out and you were not able to speak, please understand that your physical presence was vital to the success of our mission.

In an unofficial and off the record conversation yesterday, an HHSC panel member stated that it is very likly that rate reductions will be postponed as they sift through all testimony and do further research.  If this delay happens, it is a very good thing for all of us.  But please understand how important it is that we all stay plugged in and show up for any future hearings.  Continue writing letters.  Make sure you indicate that you are writing to represent independent providers.  Be specific on which codes matter to you.  While you cant speak on behalf of ITPA,  if you have joined our association, please be sure to let HHSC know that you are a dues-paying member of ITPA!  If you are not yet a member, please take advantage of our limited time offer to waive the $250 initial membership fee and JOIN NOW for your quarterly dues of $250.
